Book excerpt: Many activists, scientists and academics, have grown increasingly concerned about the privatization of science and scientific research that has resulted from increasing globalization and commercialization. This chapter examines the history of the treatment of scientific works under the international copyright regime from 1886 to the present. An early victory for access to knowledge was achieved when Haiti, backed by Great Britain, guaranteed that certain copyright exceptions intended to encourage the free dissemination of scientific and medical works were included in the original Berne Convention. However, the general long-term path has tended to reduce these exceptions, limiting whatever initial influence Haiti's earlier victory had had. This chapter, published as Chapter 3 of my book International Copyright and Access to Knowledge (CUP 2016), examines these trends in light of current debates over open publishing of scientific and medical information.
